Environmental Impairment Liability

Environmental Impairment Liability insurance covers an insured liability resulting from pollution or alleged pollution whether it occurred following a sudden incident or over a gradual period of time. A typical Public Liability policy will exclude any liability for pollution unless caused by a single identifiable event so all cases involving a gradual process will be excluded. The Environmental Impairment Liability policy will also cover the pollution damage to the insured’s own site (first party cover) as well as damage to a third party site. Clean up costs following a pollution incident can be a very heavy burden for a company to carry, and this policy would pay the costs levied by any statutory body such as the Environmental Protection Agency for such a clean up. An insured can also cover any past exposures that may only come to light at their site on some future date when purchasing such a policy. With some insurers the cover can be added to a Public Liability policy.
